General Terms and Conditions of Use

Foreword

These general terms and conditions of use (hereinafter “GTCU”) define the legal framework governing the provision of the website and services by AFTES, and define the conditions of access to and use of the services by the “User”.

These GTCU are available on the website, in the “GTCU” section.

Registration on or use of the site implies acceptance without reservation or restriction of these GTCU by the user. When registering on the site via the  Registration Form, each user expressly accepts these GTCU by ticking the box preceding the following text: “I have read, understood and agree to the GTCU”.

In the event of non-acceptance of the GTCU stipulated in this contract, the User will be unable to access the services offered by the site.

AFTES reserves the right to unilaterally modify the content of these GTCU at any time.

Article 1 - Legal notices

Article 2 - Access to the site

The aftes.fr site gives the User free access to the following services:

Online membership subscription, participation in working groups, purchase and download of publications, event registration and ticket purchasing.

Non-member Users have free access to all public information on the site, and may purchase and/or download publications, register for paid events, etc. They cannot access the site’s reserved services, however.

To access reserved services, Non-member Users must register by completing the online membership form to become a Member User. By agreeing to register for the reserved services, Member Users undertake to provide truthful and accurate information concerning their civil status and contact details, in particular their email address.

Member Users may, in addition to the services available to non-member Users, participate in working groups free of charge, purchase and/or download publications, register for events and so on, at lower prices than for Non-member Users, and in some cases free of charge.

To access the reserved services, Member Users must log in using their username and a password that will be provided on registration.

Duly registered Users may also unsubscribe by submitting a request via the corresponding page in their personal space. The unsubscription request will be processed within a reasonable period.

Note that the site is accessible free of charge from any location, to any (non-member or member) User with access to the Internet. The User shall bear any costs incurred to access the service (e.g. computer hardware, software, Internet connection, etc.).

AFTES declines all liability for events arising from cases of force majeure resulting in a malfunction of the site or server, subject to maintenance-related outages or modifications. In such cases, the (non-member or member) User agrees not to hold the publisher liable for any outages or suspension of service, even if no notice was provided.

All Users may contact the site by email at the publisher’s email address, stated in Article 1.

Article 3 - Data collection

The site warrants to the User that personal information is collected and processed in accordance with the privacy provisions of the French Data Protection Act no. 78-17 of 6 January 1978.

Under the French Data Protection Act of 6 January 1978, the User has the right to access, rectify, delete and object to their personal data. The User may exercise this right:

Article 4 - Intellectual property

Trademarks, logos, signs and all content on the site (including text, images, audio content, etc.) are protected by the French Intellectual Property Code and more specifically, by copyright law.

The User must seek prior permission from the site before reproducing, publishing or copying its content. The User agrees to use the content of the website in a strictly private capacity; use for commercial or advertising purposes is strictly prohibited.

Any representation of this website, in full or in part, by any process whatsoever, without express permission from the website operator, would constitute an infringement under Article L 335-2 et seq. of the French Intellectual Property Code.

As stipulated in Article L122-5 of the Intellectual Property Code, any User reproducing, copying or publishing protected content is required to cite the author and its source.

Article 5 - Liability

The sources of information published on the aftes.fr site are reputed to be reliable, but the site cannot guarantee that information is free from defects, errors or omissions.

Information is provided for informative purposes only and is not contractually binding. Although regularly updated, the aftes.fr site declines all liability arising from changes to administrative and legal requirements introduced after publication. Similarly, the site declines all liability regarding the use and interpretation of information hosted on this site.

The User shall ensure that their password remains confidential. Disclosing passwords in any form is prohibited. The Users bear the risks associated with the use of their login and password. The site declines all liability.

The aftes.fr site cannot be held liable for any viruses that may infect the User’s computer or other IT devices after accessing, using or downloading content from this site.

The site may not be held liable in the event of force majeure or unforeseeable and overwhelming actions by third parties.

Article 6 - Hypertext links

Hypertext links may be present on the site. Users are informed that upon clicking on such links, they will leave the aftes.fr website, which has no control over the web pages to which the links point and may under any circumstances be held liable for the content thereof.

Article 7 - Cookies

The User is informed that while visiting the site, a cookie may be installed automatically on their browser application.

Cookies are small files, temporarily stored by the browser on the hard disk of the User’s computer, that are necessary for the use of the aftes.fr site.

Cookies do not contain personal information and they cannot be used to identify an individual.

A cookie contains a randomly generated and therefore anonymous unique identifier.

Some cookies expire at the end of the User’s visit, while others persist.

The information contained in cookies is used to enhance the aftes.fr website.

By browsing the site, the User accepts them.

However, the User must consent to the use of certain cookies.

A User that rejects them will be notified that some features or pages may be inaccessible.

The User may disable these cookies in their browser settings.

Article 8 - Applicable law and competent jurisdiction

This contract is governed by French law. In the event that no amicable resolution is found to a dispute arising between the parties, the French courts shall have sole jurisdiction to hear it.
